An appeals court in Ohio has ruled that Marilyn Anderson, mother of 9-year daughter Victoria, is not allowed to smoke around her child.

The ruling came as a result of a suit brought forward by the child’s paternal grandmother Marilyn Anderson, who has custody of the child. The suit claimed that Victoria returned from her mother with a smell of cigarette smoke.

The appeals court in Warren County confirmed the concern as a danger to the child and upheld an initial ruling  that was issued in December of last year.
