What’s a Prenup Worth? Tiger Woods (And We) Will Find Out.

goldHaving a prenup in place is typically seen as the man being in charge of what would happen in the case of a divorce. If Tiger Woods and Elin Nordegren split, which seems to be certain by now, that would indicate that Nordegren’s share of Woods’ fortune may be limited. But there are reports that Nordegren is about to retain a high powered attorney and there are reports that she could challenge the rumored prenup. Will it hold up?

What will happen in the divorce is very much rumor mill territory right now.  But as so often, highly visible celebrity dramas are not just entertaining, they are also free education for the rest of us. You can already find plenty of lawyers talking about who might get what on Google News or morning TV shows. There are suggestions that Woods extreme cheating behavior may in fact violate the terms of the prenup and could potentially invalidate it. And if that is the case, Nordegren may pursue a “community property” judgment, which would give her half of Tiger’s assets. Community property states are Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin. Florida is a “separate property” state and the judgment there could be in favor of Woods, as the jurisdiction there tends to give the lion’s share of the assets to those who actually pulled them in.

Elin Nordegren reportedly is consulting with 82-year old Hollywood divorce attorney Sorrell Trope to build her case. Trope has represented Nicole Kidman, Britney Spears and Clark Gable in divorce cases before.

While Nordegren may be going through the most difficult time of her life emotionally, she may be able to cash in big of Woods’ outrageous behavior. Celebrity attorney Raoul Felder, who represented Rudy Giuliani, Mike Tyson, Elizabeth Taylor, Mick Jagger, and Jason Kidd, said that Nordegren’s best (financial) option may be to stay with Woods for now.

“So, she stands to lose lots of money if she’s suing for divorce,” Felder said in an interview with CBS Early Show co-anchor Harry Smith. “I would not bet she’s suing for divorce because (if she is), first of all, she has to have residency. … Second of all, if she were my client – and I think with any divorce lawyer – you’d want to have your client near you so you could be there for every twist and turn. She’s (said to be) off to Sweden somewhere. So I think she’s maybe just going into seclusion or licking her wounds or whatever.”
