Japan May Join International Child Abduction Treaty

legalJapan has been known as a haven for child abduction in Japanese-American child custody cases as the Japanese law does not provide any room for American parents to get their children back home.  But there is new hope that change may be coming.

Japan is the only big industrial nation not to participate in the Hague Convention on the Civil Aspects of International Child Abduction of 1980, which was signed by 81 parties. The agreement sets international legal guidelines to prevent parents from running away to other countries before a custody case is finalized. If you have been through your custody process, then you may be very well aware of this agreement.

According to a report published by Stars and Stripes, there have been renewed talks that may prompt Japan to join the treaty. “We were pleased with the initial discussions we had,” Assistant Secretary of State for East Asian and Pacific Affairs Kurt Campbell said Friday after two days of talks with new Foreign Minister Katsuya Okada. In fact, the discussions were so positive that officials believe that action is “imminent.”
