50/50 shared custody

Postby mom36 » Tue Oct 13, 2009 8:29 pm

I have a friend who is in the divorce process and is trying desperately to get shared custody of his children. He is experiencing many hurdles, as it seems as though this is not a very common thing. One of the things that he has learned has been that often times in 50/50 shared custody, the father does not pay any child support due to the fact that the children spend equal time with both parents and both parents need to provide food, shelter, clothing, etc. In his case, he is agreeing to pay the standard 32% child support for 3 children, but still wants shared custody, because he wants to spend time with his children. We could really use some advice from anyone who has 50/50 shared custody. We would love to know how you went about getting it and how you make it work for the children.

Child support and custody are serious problems battled in court. The child support and custody are treated differently. You can get 50/50 custody if your ex-spouse agrees to this set-up. If the other party does not agree, the court needs to interfere. Take note: the court always declare the needs of the child/children than of the parents.

You have to know what is covered by the law in divorce and visitation rights. Also, if you fail to maintain child support payments, it doesn't cut your right to see or visit your children.

Thank you Berna for the great advice and for the link to that website. The site had some very informative content on it and I passed the info along to my friend.
